
Loyalty Programme – Terms & Conditions
1. Definitions
In these Terms & Conditions the following expressions have the respective meanings:
Account: the Account Holders personal account within the Loyalty Programme.
Account Holder: means the individual who has satisfactorily completed the account opening process.
Loyalty Programme: means the The Sport & Travel Group Limited Loyalty Programme as described in the ‘Loyalty Points Rules’, these terms and conditions and other regulations notified to you via your Account (as amended from time to time).
Background
IMPORTANT – PLEASE READ: You will have received these terms as part of your interest in, or your application to, open an Account. The following agreement describes the terms and conditions that apply to your Account. These Terms and Conditions apply to the use of your Account and govern the relationship between The Sport & Travel Group Limited (company number: 04376255) and any member of our group of companies (“Sport & Travel”, “we” or “us”) and you. Use of your Account will constitute acceptance of these Terms and Conditions. You must therefore read them carefully. Please print a copy of these Terms and Conditions for your records. If there is anything you do not understand, please contact us via the enquiry page on our website.
2. Loyalty Programme
The Loyalty Programme is a virtual electronic money platform. When value is credited to your Account you will be receiving virtual electronic money from Us in return for your continuing custom with Us.
3. Obtaining your Account
Your Account is issued by, and remains the property of, The Sport & Travel Group Limited. We do not authorise anyone else to sell or distribute or use the Account. You can only obtain an Account from Us and via our online store at: https://www.golf-escapes.com/
4. Using your Account
You can use your Account to earn rewards and promotions on purchases or individual products.
If you wish to redeem your points against a booking please notify the relevant member of the Sport & Travel sales team so that the balance can be adjusted accordingly before proceeding to final payment. Points cannot be redeemed against bookings once the final balance has been paid.
Please note that your Account must be activated and active to enable you to earn and redeem loyalty points. Each Account Holder must only use the Account in accordance with the Loyalty Programme rules. In order to earn reward points on purchases, the Account details must be presented at the checkout stage prior to purchase (this will happen by default if you are logged in to your account). Loyalty points cannot be added after the transaction is completed.
Each Account is personal to the Account Holder to whom it is issued and neither the Account nor the reward points can be used by or transferred to any other person. The rewards points cannot be used in conjunction with any other promotion or discount. Reward points will not be awarded against the purchase of gift cards/vouchers or against the booking on which the points have been awarded. Certain other products may also be excluded from the Loyalty Programme or the reward points awarded increased or reduced from time to time at our discretion subject to notice being provided at https://www.golf-escapes.com/golf-escapes-rewards-programme/. Any reward points earned on purchases which are subsequently cancelled or refunded will be deducted from the Account. 5. Expiry
Your Account does not have an expiry date. However, if you do not use your Account for a period of eighteen months or more, your Account will cease to be valid and any remaining loyalty points or other promotional offers stored on it will expire.
Expired value cannot be transferred to a new account or be otherwise redeemed. You will not be able to use your Account once it has ceased to be valid.
6. Cancellation
You have the right to cancel your Account at any time by giving notice to Us via the website at https://www.golf-escapes.com/golf-escapes-rewards-programme/ (see details on the website).
If you wish to cancel your Account, you must contact us in writing and make it expressly clear that this is your intention and the reason for the cancellation (if any).
7. Registering your Account
To protect the stored value on your Account from loss, theft or damage you must not share your account details or passwords with any third party and follow any advice on keeping your Account secure provided on our website.
If you need to change any of the details you have registered with your Account, please contact customer services via our telephone number or alternatively, you can make changes through the website. You will be asked to verify your identity and our customer service team will require you to produce personal details and information to verify you are the Account holder.
8. Loss, theft, damage, misuse
You should treat your Account like a bank account. If you lose your Account details or they are obtained by any third party you may lose any value which is stored on it in the same way as if you lost your bank card.
You should immediately report any loss, theft, fraudulent or unauthorised use of your Account to our customer services team or via our ‘contact us’ function on our website.
In the event of loss, theft, fraud or other unauthorised use of your Account, or if your Account is damaged or malfunctions, we may, at our sole discretion, replace your Account and transfer any credit value stored on it at the time of reporting to a replacement Account. Non-exhaustive circumstances in which we may determine, in our sole discretion, that we will not replace your Account or accept the redemption of any rewards/points include those where we reasonably believe that the notified incident has been caused by your wilful breach of these Terms and Conditions or if there are reasonable grounds for suspecting that you are or have been engaged in careless, negligent, fraudulent or other unlawful conduct.
9. Data Protection and Privacy
As part of the Account registration process on the website you will be asked to provide certain personal information, including your name, date of birth, address, contact details and other details to help secure your Account. We are committed to maintaining the security of your personal information in accordance with the requirements of the General Data Protection Regulation and will take all reasonable steps to ensure that your personal data is kept secure against unauthorised access, loss, disclosure or destruction.
The Privacy Policy (link available at the footer of our website: https://www.golf-escapes.com/) will apply whenever you provide us with personal information and is incorporated by reference into these Terms and Conditions. Except as required by law, or in accordance with these Terms and Conditions and the Privacy Policy, your personal information will not be passed to any other persons without your permission.
10. Liability of The Sport & Travel Group Limited
Neither The Sport & Travel Group Limited, nor any member of its corporate group shall be held liable for any default resulting directly or indirectly from any cause beyond our control, including but not limited to, failure of network services and failure of data processing systems. To the extent permitted by law, all conditions or warranties implied by law, statute or otherwise are expressly excluded.
The Sport & Travel Group Limited will not be liable to you for:
• any loss of income, savings, business, goodwill or profits arising out of this agreement;
• any unauthorised access to or alteration, theft or destruction of your Account;
• the consequences of any delay or mistake relating to the use of your Account caused by any circumstances beyond our control;
• any loss or damage which was not caused by our breach of this agreement or breach of our legal duty of care;
• any loss or damage which was not a reasonably foreseeable result of either our breach of this agreement or breach of our legal duty of care. Loss or damage is “reasonably foreseeable” if, at the time we entered into this agreement, such loss was contemplated by you and by us; or
• any loss or damage suffered by you as a result of you failing to take reasonable precautions against such loss or damage.
This agreement does not affect your statutory rights and must be read subject to those rights. If you require more information on your statutory rights, you should contact your local authority Trading Standards Department or Citizens Advice Bureau.
The Sport & Travel Group Limited does not represent or warrant that your Account will always be accessible or accepted for all purchases from Us.
The Financial Ombudsman Compensation Service is not applicable to your Account. The Sport & Travel Group Limited does not offer any other compensation schemes to cover losses claimed in connection with your Account.
11. Variation and assignment
We reserve the right to amend or waive any provision of these Terms and Conditions from time to time and at any time, or to terminate the Loyalty Programme on reasonable notice. The Terms and Conditions applicable to the use of an Account shall at any time be the terms and conditions published on the website (https://www.golf-escapes.com/golf-escapes-rewards-programme/) and your continued use of an Account shall constitute your acceptance of such terms and conditions. We will also provide notices on our website and/or e-mail you to let you know about changes to these Terms and Conditions.
We may assign the benefit of these Terms and Conditions to any other company in the same group of companies as The Sport & Travel Group Limited. If we assign the benefit of these Terms and Conditions, your rights will not be affected.
12. Entire Agreement; Construction
This agreement (as amended from time to time) constitutes the entire agreement between you and The Sport & Travel Group Limited and supersedes all prior proposals and all other agreements in respect of the subject matter of this agreement. If any provision of this agreement is illegal or unenforceable, that provision will be deleted from this agreement, and the remaining terms will not be affected.
13. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales.
